The terms that govern your use of the PEWIT Labs website, plugins and related services.

These Terms of Service ("Terms") govern your access to and use of the websites, plugins, and services provided by [COMPANY_LEGAL_NAME] ("PEWIT Labs", "we", "us"), including the AI Media Toolkit plugin and any other products listed on pewitlabs.com (the "Services"). By installing, accessing, or purchasing our Services, you agree to these Terms.
1. Who we are

2. Payments and Merchant of Record
All purchases of paid plans, subscriptions and credit packs are processed by Freemius, Inc., which acts as the Merchant of Record (Reseller) for our products. This means Freemius is the seller of record for the transaction, handles billing, applicable taxes (incl. VAT), invoices, refunds and chargebacks. By purchasing, you also accept the Freemius Buyer Terms presented at checkout. We remain responsible for the Services themselves (functionality, support, updates).
3. Licenses, plans and activations
- Free: single-image generation, library scanning and a basic report; one site.
- Pro: full feature set for one production site.
- Agency: full feature set for unlimited sites, plus white-label.
Plan details, pricing and limits are shown on /pricing at the time of purchase. Paid plans are sold as recurring annual (or monthly) subscriptions that renew automatically until cancelled. You may cancel anytime through your Freemius customer account; cancellation stops future renewals.
4. The software is GPL
Our WordPress plugins' PHP code is licensed under the GNU General Public License (GPL). Your payment is for access to automatic updates, premium features, support, and (optionally) managed AI services — not for the underlying code license. See /legal/eula.
5. Managed AI credits and your own API key (BYOK)
You may use the Services with your own OpenAI API key (BYOK) — in which case you are solely responsible for your OpenAI usage and costs — or purchase managed AI credits from us. Credits are consumed as images are processed and are subject to the Acceptable Use Policy (/legal/acceptable-use).
6. Acceptable use
You must not misuse the Services, including: reselling or sharing license keys, abusing managed AI credits, sending unlawful or infringing content to AI processing, or attempting to bypass licensing or security controls. See /legal/acceptable-use.
7. Third-party services
The Services rely on third parties, including OpenAI (AI processing) and Freemius (billing/licensing). Your use of those features is also subject to the respective third party's terms. We are not liable for outages, changes, or pricing of third-party providers.
8. Warranties and disclaimer
The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties. We strongly recommend testing on a staging site and keeping auto-backup enabled before bulk operations. We are not responsible for data loss resulting from disabling backups or ignoring warnings.
9. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the Services is limited to the amount you paid us (via Freemius) in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. Nothing limits liability that cannot be limited under applicable law, including mandatory consumer rights.
10. Consumer rights
If you are a consumer in the EU/EEA, you have statutory rights that these Terms do not affect, including the right of withdrawal for digital content (subject to the conditions in /legal/refunds).
11. Changes
We may update these Terms; material changes will be announced on the website. Continued use after changes means you accept the updated Terms.
12. Governing law and disputes
These Terms are governed by [GOVERNING_LAW]. Mandatory consumer protection rules of your country of residence still apply. Disputes will be resolved by the competent courts of [COMPANY_COUNTRY], without prejudice to consumer rights to bring proceedings in their place of residence.
